Nomiq Partner Network Terms

Commercial draft for programme implementation. These terms require review by a qualified lawyer before public launch. The governing-law clause is intentionally not invented.
1. Programme status
The Nomiq Partner Network is an approval-only commercial referral programme. Applying does not guarantee acceptance, earnings, territory, exclusivity or continued participation. Nomiq may reject, suspend or close an account where necessary to protect coaches, customers or the programme.
2. Eligibility and approval
Applicants must supply accurate information, have a relevant audience or network, be legally able to enter a commercial agreement, and disclose conflicts. Approval is manual. The standard tier is 25%; the high-volume 30% tier requires separate written approval.
3. Eligible referrals
A referred coach must be genuinely new to Nomiq, register through a valid partner link or be approved as a direct introduction, publish a live booking page, connect an eligible payment account, and receive a genuine paid booking. Existing coaches, duplicate accounts, self-referrals, related-party bookings, test payments, artificial activity, refunded or disputed bookings may be rejected.
4. Attribution
A valid partner click may attribute a coach for 60 days. The last valid partner link generally wins. Nomiq may correct attribution using verifiable records. Partners cannot alter attribution. Nomiq’s records are authoritative, subject to correction of clear errors.
5. Commission
For 12 months after an eligible coach activates, an approved standard partner may earn 25% of Nomiq’s net platform fee actually retained on eligible bookings. Processing fees, taxes, refunds, disputes, credits, discounts, zero-fee bookings and amounts not retained by Nomiq are excluded. Founding Coach and Coach Refer a Coach fee-free benefits do not generate commission and programmes do not stack unless Nomiq records a written exception.
6. Validation and reversals
Commission remains pending through Nomiq’s dispute and validation period. Nomiq may reverse, disqualify or offset commission for refunds, disputes, fraud, chargebacks, duplicate attribution, policy breaches, calculation errors or ineligible activity. Paid ledger history will be retained for audit purposes.
7. Payouts
Eligible commission is calculated monthly and paid monthly in arrears through an approved method. The minimum payout is CHF 25 or local-currency equivalent; smaller balances carry forward. Partners are responsible for accurate payout and tax information. Bank, currency-conversion and recipient fees may apply. No earnings are guaranteed.
8. Promotion and disclosure
Partners must describe Nomiq accurately, make their commercial relationship clear, comply with advertising, privacy, anti-spam and consumer laws, and use approved assets. Partners may not impersonate Nomiq, bid on protected brand terms without permission, make unapproved earnings claims, use misleading discounts, send unsolicited bulk messages or present themselves as an employee or agent.
9. Data and confidentiality
Partners receive only the reporting necessary to understand their own referrals and commissions. They must protect confidential information and personal data, use it only for the programme, and notify Nomiq promptly of any suspected misuse or security incident.
10. Termination
Either party may end participation by written notice. Nomiq may suspend access immediately for fraud, abuse, legal risk, misleading promotion or material breach. Valid commission already earned remains subject to validation, offsets and these terms; no new commission accrues after termination unless Nomiq confirms otherwise.
11. Liability and changes
To the extent permitted by law, Nomiq does not guarantee uninterrupted service, conversion levels or earnings. Nomiq may update the programme prospectively and will communicate material commercial changes. Nothing excludes liability that cannot legally be excluded.
